Terms of Service

Nordic Connect, operated by Nordic Media. Last updated: 10 August 2026.

These terms form a binding agreement between you and Nordic Media ("we", "us"), established in Alberta, Canada, governing your access to and use of the Nordic Connect platform (the "Service"). By accessing or using the Service you agree to them. If you are agreeing on behalf of an organisation, you confirm you have authority to bind that organisation.

Nordic Media is a trading name of Nordic Filmworks LTD, a company registered in Alberta, Canada.

1. The Service

Nordic Connect is a business platform that lets a marketing agency and its clients manage contact records, send and receive SMS and email, connect social accounts, view analytics and reports, schedule and publish social content, and generate AI-assisted summaries of that activity. Features available to a given workspace depend on the modules enabled for it.

2. Eligibility and accounts

You must be at least 18 and capable of forming a binding contract. Access is granted by Nordic Media to individuals it or the client that owns the workspace has authorised — normally by approving a specific address for Google sign-in, and during the current transition also by a shared access password. You are responsible for keeping your sign-in credentials secure and for all activity under your account, and you must tell us promptly at info@nordic.media if you suspect unauthorised access. Do not share credentials or let anyone else use your account.

3. Connected platform accounts

The Service can connect to third-party platforms including TikTok, Facebook, Instagram, YouTube, Google and X. When you connect an account:

  • You confirm you own the account or are authorised by its owner to connect it.
  • You authorise us to access it strictly within the permissions you grant on that platform's consent screen, and solely to provide the features you enable.
  • You authorise us to publish content you have created and scheduled to that account, on your instruction. We do not post on your behalf otherwise.
  • Your use of each platform remains governed by that platform's own terms and policies, including the TikTok Terms of Service and Community Guidelines. Where those terms conflict with ours in respect of that platform, theirs prevail.
  • You may disconnect an account at any time, in the Service or from the platform's own settings. Platforms may change or withdraw their APIs, which can interrupt or end a feature through no fault of ours.

4. Your content and your responsibilities

You retain all ownership of the content, contact data and materials you put into the Service ("Your Content"). You grant us a non-exclusive, worldwide, royalty-free licence to host, store, transmit, reformat and display Your Content solely to operate the Service for you, including transmitting it to the platforms and providers you have connected. This licence ends when the content is deleted.

You are responsible for Your Content, and you warrant that:

  • You hold all necessary rights, licences and permissions in it, including to any music, footage, images and trade marks it contains.
  • It does not infringe any third party's intellectual property, privacy or other rights, and is not unlawful, defamatory, deceptive or harmful.
  • Every contact you message through the Service has given the consent required by applicable law — including Canada's Anti-Spam Legislation (CASL), PIPEDA and Alberta's PIPA, and, for recipients elsewhere, the US TCPA and CAN-SPAM and the UK/EU GDPR and PECR — that every message identifies you and offers a working unsubscribe, that you honour opt-out requests promptly, and that you can evidence that consent on request.

5. Acceptable use

You must not, and must not permit anyone else to:

  • Use the Service to send unsolicited bulk messages, or to harass, defraud or impersonate anyone.
  • Breach any connected platform's terms, community guidelines, rate limits or automation rules.
  • Upload malware, attempt to gain unauthorised access to the Service or another workspace, or interfere with its operation or security.
  • Scrape, reverse-engineer, resell or create a competing product from the Service, or access it to build a substantially similar service.
  • Use the Service in breach of applicable law, sanctions or export controls.

We may investigate suspected breaches and suspend access where necessary to protect the Service, our users or third parties.

6. Fees

Where the Service is provided under a paid engagement, fees, billing frequency and payment terms are set out in the applicable order or agency agreement between you and Nordic Media. Unless that agreement says otherwise, fees are payable in advance and are non-refundable once the period has begun, and we may suspend the Service for accounts overdue by more than 30 days.

7. Intellectual property

The Service itself — its software, design, and documentation — is owned by Nordic Media and its licensors and is protected by intellectual property law. These terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service for your internal business purposes. All rights not expressly granted are reserved. If you send us feedback we may use it without obligation to you.

8. AI-generated output

Some features produce summaries, sentiment indicators, suggested tags and content scores using automated systems. This output is advisory, may be inaccurate or incomplete, and must be reviewed by a human before you rely on it or publish anything based on it. It is not professional advice, and you remain responsible for anything you publish.

9. Availability

We aim to keep the Service available and to give reasonable notice of planned maintenance, but unless a separate written service-level agreement applies we do not guarantee uninterrupted or error-free operation. The Service depends on third-party platforms and infrastructure whose outages, API changes and rate limits are outside our control.

10. Suspension and termination

You may stop using the Service and ask us to close your workspace at any time. We may suspend or terminate access on notice if you materially breach these terms, if required by law or by a connected platform, or if your continued use poses a security or legal risk. On termination your right to use the Service ends and Your Content is deleted in line with our Privacy Policy. If you need a copy of anything before that, ask us at info@nordic.media and we will agree what we can provide. Sections 4, 7 and 11 to 14 survive termination.

11. Disclaimers

Except as expressly stated in these terms, and to the fullest extent permitted by law, the Service is provided "as is" and "as available" and we exclude all implied warranties, including those of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that analytics figures obtained from third-party platforms are complete or accurate — they are reported to us by those platforms and may be restated by them.

12. Limitation of liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be limited.

Subject to that, we are not liable for loss of profits, revenue, goodwill, anticipated savings, business or data, or for any indirect or consequential loss, however arising; and our total aggregate liability arising out of or in connection with these terms is limited to the greater of the fees you paid us for the Service in the 12 months before the event giving rise to the claim, or CAD $100.

13. Indemnity

You will indemnify us against claims, losses and reasonable costs arising from Your Content, your breach of these terms, or your breach of a connected platform's terms or of any law governing your messaging or publishing activity.

14. Changes to these terms

We may update these terms as the Service develops. The "last updated" date above reflects the current version. For material changes we will give account holders at least 30 days' notice by email; continued use after a change takes effect constitutes acceptance, and if you do not accept it you may terminate as described in section 10.

15. Governing law

These terms and any dispute arising out of them are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in it, without regard to conflict of laws rules, and the courts of Alberta have exclusive jurisdiction. Nothing here displaces any non-waivable right you have under the consumer protection law of your own province or country. If any provision is held unenforceable, the rest remains in force. These terms, together with any order or agency agreement between us, are the entire agreement on their subject matter. You may not assign them without our written consent; we may assign them to an affiliate or successor.
